Special Board Meeting Cancellation Notice

Due to the ongoing association member confusion and misinformation regarding resident rights, board meeting protocol, meeting/agenda notice and governing documents and state law, the board is going to take step back and cancel the November 19, 2015 business meeting of the board. Residents need to understand that it's a privilege rather than a right to attend the Open Forums of the business meetings of the Board. Moving forward the board will no longer provide advance notice but follow the letter of the Texas State Law for meeting notice and posting of the agenda. Effective September 1, 2015, the laws for notice for HOA board meetings have changed and MGHOA will follow this legislature update.

In order to protect the current VOLUNTEER ELECTED Board the next business meeting of the board will not be scheduled until the new management transition takes place and the professional property manager, will be able to assist the association in direction and protect the association (you and I) from having any legal action taken. If that was to happen all of us would pay.

To clarify, the association has responsibility for its common elements as well as the management and operation of the association’s business affairs – – all in accordance with standards established by the governing documents created when the community was first developed. To the extent that an association (typically a non-profit corporation) has such authority and control, it is its board of directors that carries out these duties and responsibilities.

Members of the board of directors of an association serve without compensation unless the bylaws of the association provide to the contrary. The board’s authority includes all of the powers and duties enumerated in general law, as long as these powers are not inconsistent with the provisions of the documents governing the association.

The board encourages every homeowner to attend the Re-Zoning Hearing scheduled on December 8, 2015 so that you may see and hear the facts pertaining to the proposed rezoning and make your judgement based on the facts not hearsay and interpretation. No final action or vote will be taken on the proposed re-zoning application until January when the City Council votes, this will provide ample opportunity to schedule a meeting of the homeowners so they may voice their opinions and comments regarding the proposed re-zoning.
